TERMS OF SERVICE

Last updated October 8, 2026

AGREEMENT TO OUR LEGAL TERMS

We are Dumke Ventures UG (haftungsbeschränkt) ("Company," "we," "us," "our"), a company registered in Germany at Ebersprung 2, 16321 Bernau, Germany.

We operate the mobile application Thirdy (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Thirdy is a self-improvement app built around a personal 30-day program: you set one goal, receive a short AI-generated audio chapter each morning told from the perspective of your future self, and check in honestly each evening, which shapes the next chapter. The "future self" voice is generated by artificial intelligence. It is not a human, a therapist, or a medical or mental-health professional.

You can contact us by phone at +49 33383 380112, by email at info@thirdy.app, or by mail to Dumke Ventures UG, Ebersprung 2, 16321 Bernau, Germany. Our full legal notice is available in our Impressum.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Dumke Ventures UG, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We may change these Legal Terms in the future. A changed version is published on this page with a new "Last updated" date and applies only to people who start using the Services or start a subscription after that date. If you accepted an earlier version, that earlier version continues to apply to you and to your existing subscription.

You must be at least 16 years old to use the Services. If you are under 18, you may only buy a subscription with the consent of your parent or legal guardian.

We recommend that you print a copy of these Legal Terms for your records.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

Thirdy is a self-improvement app built around a personal 30-day program. You set one goal and name what stands in its way. Each morning the App delivers a short audio chapter written and voiced for you, together with a daily affirmation and one small task; each evening you check in honestly, and the next chapter is written from what you actually did. The program includes playbacks on days 7, 14, and 21, unlockable stories, sleep and wind-down audio, and a voice message you can record on day 1 that is played back to you on day 30.

The "future self" voice and all generated content are produced by artificial intelligence. It is not a human, a coach, a therapist, or a medical or mental-health professional, and Thirdy provides general self-improvement features only. It does not give medical, psychological, financial, or crisis advice.

2. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Our Content and Marks are protected by copyright and trademark laws and applicable treaties in Germany, the European Union, and around the world.

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and to download or use the Content to which you are properly granted access, solely for your personal, non-commercial use. Any content generated for you within the Services may be used for your own personal, non-commercial purposes.

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) all registration and other information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information and promptly update it as necessary; (3) you have the legal capacity and you agree to comply with these Legal Terms; (4) you are at least 16 years old; (5) you will not access the Services through automated or non-human means, whether through a bot, script, or otherwise; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

If you provide information that is untrue or misleading in a way that breaches these Legal Terms, we may suspend or end your access as described in Section 12.

4. USER REGISTRATION

You use the App without creating a username, email login, or password: the App creates an anonymous account identifier on your device. This account and its content are tied to that device unless we offer and you use a migration or backup mechanism. You are responsible for the use of the App on your device. If any name or content you provide within the App is inappropriate, obscene, or otherwise objectionable, we reserve the right to remove or refuse it.

5. PURCHASES AND PAYMENT

All purchases and subscriptions are processed through the Apple App Store, with subscription management facilitated by RevenueCat. We do not collect or store your full payment card details; payment is handled by Apple and its payment processors under Apple's terms and privacy policy. By making a purchase, you agree to pay the prices displayed to you at the time of purchase, which are charged to your Apple ID.

Purchases are made through the Apple App Store, which collects payment and handles refunds on our behalf or in its own name under its own terms. Your rights against us under these Legal Terms and under mandatory consumer law are not affected. Prices and availability are subject to change; this does not affect the price of an existing subscription (see Section 6).

No VAT is charged under § 19 UStG (small business rule of the German VAT Act). The prices shown in the App Store are charged by Apple and include any VAT that Apple collects for the sale.

6. SUBSCRIPTIONS

Billing and Renewal

The Services may be offered on a subscription basis. The price and billing period for each subscription are displayed to you on the purchase screen before you confirm your purchase. Payment is charged to your Apple ID upon confirmation of purchase.

Your subscription automatically renews for the same billing period at the same price unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours before the end of the current period. If your billing period is longer than one month, after the first period your subscription continues for an indefinite time and you can cancel it at any time with effect at the end of the then-current month. We will not raise the price of an existing subscription without your consent. If the price changes, the App Store will inform you in advance and ask for your consent before the increase takes effect, and you can cancel before the new price takes effect.

Free Trials

If we offer a free trial, the length and terms of the trial are disclosed on the purchase screen. Unless you cancel before the end of the trial, the trial will automatically convert into a paid subscription at the price disclosed. Any unused portion of a free trial period is forfeited when you purchase a subscription.

Cancellation

You can cancel your subscription at any time in the App under You > Manage subscription, which opens your Apple subscription settings, or directly in your Apple ID settings. Cancellation takes effect at the end of the current paid period, and you keep access until then. Deleting the App does not cancel your subscription. For questions, email us at info@thirdy.app.

7. CANCELLATION AND REFUNDS

Purchases are processed by Apple, and refund requests are handled in accordance with Apple's policies. To request a refund, please use the refund process of the Apple App Store.

Your statutory right of withdrawal (EU/EEA consumers). If you are a consumer in the EU/EEA and we are your contracting party, you have a statutory right to withdraw from the contract within 14 days without giving reasons (§§ 312g, 355 of the German Civil Code (BGB)). For digital content, this right ends early only if, before the end of the withdrawal period, you have expressly agreed that we begin performance, you have confirmed that you know you thereby lose your right of withdrawal, and we have sent you a confirmation of the contract (§ 356 (6) BGB). For digital services, the right ends when the service has been fully provided after you gave the same consent and confirmation (§ 356 (5) BGB); if you withdraw after asking us to start early, you owe a proportionate amount for the service provided until the withdrawal (§ 357a (2) BGB). Where Apple sells the subscription to you in its own name, Apple's terms govern the purchase, including withdrawal and refunds. Nothing in these Legal Terms limits any mandatory statutory rights you have.

Withdrawal instructions. You can withdraw by sending us a clear statement, for example by email to info@thirdy.app or by post to Dumke Ventures UG (haftungsbeschränkt), Ebersprung 2, 16321 Bernau, Germany. To meet the deadline, it is enough to send your statement before the withdrawal period ends. If you withdraw, we will refund all payments received from you without delay and at the latest within 14 days, using the same means of payment you used, unless Apple processes the refund.

Model withdrawal form. To Dumke Ventures UG (haftungsbeschränkt), Ebersprung 2, 16321 Bernau, Germany, info@thirdy.app: I/We hereby withdraw from the contract concluded by me/us for the provision of the following service / digital content: ___. Ordered on: ___. Name of consumer(s): ___. Address of consumer(s): ___. Date: ___.

8. PROHIBITED ACTIVITIES

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

  • Systematically retrieve data or other content from the Services to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
  • Circumvent, disable, or otherwise interfere with security-related features of the Services.
  • Use the Services to harass, abuse, defame, or harm another person. When you mention other people in the App (for example a partner, family member, or witness), share only what you are allowed to share and only what is needed for your own program.
  • Use any information obtained from the Services to harass, abuse, or harm another person.
  • Use the Services in a manner inconsistent with any applicable laws or regulations, or to upload or transmit viruses, malware, or other harmful material.
  • Attempt to impersonate another user or person, or use the username of another user.
  • Reverse engineer, decompile, or disassemble any of the software comprising or in any way making up a part of the Services, except as expressly permitted by applicable law.
  • Use the Services as part of any effort to compete with us, or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.

9. MOBILE APPLICATION LICENSE

Use License

If you access the Services via the App, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, and to access and use the App on such devices strictly in accordance with these Legal Terms. You shall not: (1) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App, except to the extent permitted by applicable law; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the App; or (4) use the App for any revenue-generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended.

Apple App Store

If you obtained the App from the Apple App Store, Apple's standard Licensed Application End User License Agreement applies to your use of the App, and these Legal Terms add to it. In addition: (1) these Legal Terms are concluded between you and us only, not with Apple, and we, not Apple, are solely responsible for the App and its content; (2) the license granted to you is limited to a non-transferable license to use the App on Apple-branded devices that you own or control, in accordance with the usage rules in the Apple Media Services Terms and Conditions; (3) Apple has no obligation to provide maintenance or support for the App; (4) if the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App, if any; to the extent permitted by law, Apple has no other warranty obligation; (5) we, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws; (6) if a third party claims that the App or your possession and use of it infringes that third party's intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling and discharging that claim; (7) you represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a "terrorist supporting" country and (ii) you are not listed on any U.S. government list of prohibited or restricted parties; (8) you must comply with applicable third-party terms of agreement when using the App; and (9) Apple and its subsidiaries are third-party beneficiaries of these Legal Terms and may enforce them against you as a licensee of the App. Questions, complaints or claims about the App go to us at the address in Section 19.

10. AI-GENERATED CONTENT

Thirdy's core feature is AI-generated content. The goal, obstacles, check-ins, and other details you provide are processed by us and by our AI service providers, currently OpenAI (text generation and safety checks) and ElevenLabs (speech synthesis), to write and voice your daily chapters, stories, affirmations, and playbacks. Details are in our Privacy Policy.

The "future self" voice is not a human and not a real person, and the synthesized voice does not belong to any real speaker you know. Generated content may be inaccurate, inappropriate, or unexpected, and must not be relied upon as professional, medical, psychological, financial, or crisis advice. If you are in crisis or need help, contact a qualified professional or your local emergency services.

11. PRIVACY

Information on how we process your personal data is in our Privacy Policy at /privacy. The Privacy Policy is information under data protection law and is not part of this contract. Our full legal notice (Impressum) is available at /impressum.

12. TERM AND TERMINATION

These Legal Terms remain in force while you use the Services. We may end a free use of the Services at any time. A paid subscription runs until you cancel it as described in Section 6. We may suspend or end your access before then only for good cause (§ 314 BGB), in particular a serious or repeated breach of Section 8 or of applicable law, and where appropriate only after a warning. If we end a paid subscription early for a reason you are not responsible for, you will not be charged for the unused period, we will refund any amount you have paid for the period after termination, and we will help you obtain that refund where Apple processed the payment. Your statutory rights remain unaffected.

You may stop using the Services at any time by deleting your account. You can delete your account in the App under You > Delete my account, or by emailing us at info@thirdy.app. Deleting your account in the App immediately and permanently erases your profile, program, check-ins, generated content, audio and voice recordings, and your anonymous account; this cannot be undone. Our Privacy Policy explains which records are kept for longer. Deleting the App alone does not delete your account, and deleting the App or your account does not cancel an active subscription; please cancel subscriptions as described in Section 6.

13. DISCLAIMER

The statutory rules on defects and non-conformity apply to the Services, including §§ 327 et seq. of the German Civil Code (BGB), in particular §§ 327d et seq. BGB, for paid digital content and digital services. We do not promise any particular result from using the Services, for example that you will reach your goal. The "future self" voice is not a human and not a real person. All chapters and audio are generated automatically, may contain errors, and are not professional, medical, psychological, or crisis advice.

14. LIMITATION OF LIABILITY

We are liable without limitation: (a) for damages arising from injury to life, body, or health caused by a negligent or intentional breach of duty by us; (b) for damages caused by our intent (Vorsatz) or gross negligence (grobe Fahrlässigkeit); (c) for defects that we have fraudulently concealed (arglistig verschwiegene Mängel); (d) to the extent we have assumed a guarantee (Garantie); and (e) under the German Product Liability Act (Produkthaftungsgesetz) and any other mandatory statutory liability.

In the case of slight (ordinary) negligence, we are liable only for the breach of an essential contractual obligation (Kardinalpflicht), that is, an obligation whose fulfillment is essential to the proper performance of the contract and on whose observance you may regularly rely. In that case, our liability is limited to the foreseeable damage typical for this type of contract. Any further liability for slight negligence is excluded.

In the case of loss of data, our liability for the effort of restoration is in any event limited to the amount that would have been incurred had you made regular and risk-appropriate backup copies of your data.

The above limitations and exclusions also apply in favor of our legal representatives, employees, and vicarious agents (Erfüllungsgehilfen). Nothing in this Section limits, and the above does not apply to: (i) any mandatory statutory liability, including under the German Product Liability Act and under data protection law (e.g., Article 82 GDPR); (ii) your statutory rights as a consumer; or (iii) your statutory rights and remedies in respect of defects or non-conformity of paid digital content or digital services under §§ 327 et seq. of the German Civil Code (BGB), which remain unaffected.

15. GOVERNING LAW AND DISPUTE RESOLUTION

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country in which you have your habitual residence.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) within the meaning of the German Consumer Dispute Resolution Act (VSBG).

16. USER CONTENT

You keep all rights in the content you provide, such as your goal, check-ins and the voice message you record for day 30. You grant us a non-exclusive, royalty-free right to store, process and transmit that content only as needed to provide the Services to you, including through the service providers named in our Privacy Policy. This right ends when you delete your account. If you send us feedback or suggestions, we may use them to improve the Services without any obligation to you.

17. CALIFORNIA AND OTHER US USERS

Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Services are provided by Dumke Ventures UG (haftungsbeschränkt), Ebersprung 2, 16321 Bernau, Germany, info@thirdy.app. To file a complaint or get more information, write to that address. Information about privacy rights under US state laws, including the CCPA/CPRA, is in Section 13 of our Privacy Policy.

18. GENERAL

If any provision of these Legal Terms is invalid, the remaining provisions remain in effect, and the statutory rules apply in place of the invalid provision (§ 306 BGB).
